Judicial debt collection in Ireland.

Should your customer in Ireland not pay in the first phase of debt collection in Ireland, then it may be necessary to take legal action against your debtor.

Which court in Ireland do you need to go to?

In civil matters in Ireland (ie between two private parties), the civil court is responsible.

There are three courts of first instance in Ireland. The District, Circuit and High Court.

These three different courts are responsible for disputes concerning different amounts.

Below is an account of the amounts and the jurisdiction.

• The district court handles up to € 15,000.
• The Circuit Court handles claims from a creditor up to € 75,000.
• And finally the High Court which has jurisdiction for cases over € 75,00

Sometimes it is required that you be represented by a solicitor. However, this varies from case to case and depends on the complexity of the dispute in question.

To start a case, you need to file an application to the correct Courts Service office. The petition must be written in either English or Irish and must be submitted in person to the relevant court.

Will I have to pay court charges?

Yes, it costs to file a lawsuit in Ireland. The cost is paid directly upon application and the cost varies depending on the size of the claim.

Judgment in default.

In cases in Ireland where the case concerns a specific amount, and where the debtor does not dispute the creditor’s claim, then a judgment by default can be imposed.

That is, a judgment without the court going into more detail on the details of the case.

There is no upper amount limit for a judgment by default to be imposed. The cases are handled in the same court as the usual civil proceedings and operate as follows:

The debtor will be served on the lawsuit. If he does not “defend” himself in any way before the deadline, then a creditor can actively request that a judgment in default be issued by the court.

The lawsuit must clearly state information about the parties in the case as well as the size of the claim, what it comes from and what payment demands have previously been made for the debt.

Judgment in default is a tool that is particularly suitable for debt collection in Ireland as most debt collection cases are not disputed.

Enforcement proceedings in Ireland.

This is a step in debt collection in Ireland where a creditor gets help from the state to get paid for his claim provided there is a judgment.

If a creditor in Ireland has taken legal action against the debtor, it has probably resulted in an ordinary judgment from the court or a judgment in default.

The judgment then stipulates that the debtor has a bond to pay a specific amount of money to the creditor.

But if it is not done voluntarily by the debtor, then the creditor can apply for Enforcement.

In short, it can be said to mean that the creditor asks the Irish authorities for help to get the debtor to pay through coercive measures.
